Terms.

Before this page goes live: a business address is still to be decided, the effective date confirmed, and this page should be read by a solicitor. It has been narrowed deliberately, see the note at the end.

About these terms

These terms cover your use of naylorandco.com and the travel design work Naylor & Co. carries out for you. They sit alongside, and do not replace, the booking terms of Colletts Travel Limited, which govern the travel arrangements themselves.

Naylor & Co. is the trading name of Jessica Naylor, an independent travel consultant. All bookings are made through Colletts Travel Limited and are arranged under their licence, with Colletts Travel Limited acting as the licence holder.

The work

The practice designs and arranges private travel for a small number of households. The work includes an introductory conversation, a structured brief, itinerary design, supplier selection, booking, pre-departure documentation, and support during the journey.

Our role

For travel arrangements, Naylor & Co. acts as agent for and on behalf of suppliers, and the contract for the underlying travel service is between you and the supplier or the licence holder. Each supplier's own terms apply.

Where arrangements are combined into a single product, the booking may be classified under the Package Travel and Linked Travel Arrangements Regulations 2018. Where that is the case you will be told at the point of confirmation, and the principal liability defined by those Regulations sits with the licence holder rather than with Naylor & Co.

Financial protection for your booking

Financial protection for your travel arrangements is a matter for the licence holder, not for this practice. What applies to your booking, and what it covers, is set out in the booking terms and conditions of Colletts Travel Limited. Please read them. You will also be told, in writing and before you confirm, which protection applies to your particular arrangements.

Quotes and booking

Prices

The total price quoted includes all mandatory charges known at the time of quoting. Where a cost genuinely varies with use, such as hotel incidentals, in-room dining, optional excursions or foreign exchange on local card spend, it is flagged separately and not included in the headline figure.

Prices are quoted in pounds sterling or US dollars as suits the booking. Exchange rate movement between quote and balance can affect journeys not denominated in sterling. Where a rate is fixed, that is stated in writing.

The design fee

Where the practice charges a fee for research and design, the amount, what it covers, and whether it is refundable or credited against the final cost are agreed with you in writing before any fee is charged and before any design work begins. Where a fee is credited against a journey, the credit applies to bookings made through this practice.

Insurance, passports and entry requirements

Travel insurance is a requirement for every journey arranged by the practice, and should cover medical evacuation, repatriation, cancellation and interruption, baggage, and any pre-existing conditions. Travelling without it is at your own risk. The practice is not authorised to give regulated insurance advice and recommends you take independent advice.

Ensuring that passports, visas, electronic travel authorisations and health requirements are valid for every destination and connecting country is your responsibility. Known requirements will be flagged and you will be pointed to the authoritative sources, but third-party information cannot be guaranteed accurate at the date of travel.

Liability

Subject to protections that cannot be excluded under UK consumer law:

Events outside our control

Neither party is liable for failure or delay caused by events beyond reasonable control, including war, civil unrest, terrorism, pandemic, government action, airspace closure, natural disaster and supplier failure. In those cases the practice will work in good faith to find alternatives or to refund what can be refunded.

Complaints

If something goes wrong during a journey, tell the practice and the supplier or local representative straight away, so it can be dealt with while you are still there. For a formal complaint afterwards, write to [email protected] within twenty-eight days of returning. It will be acknowledged within five working days.

Complaints about the travel arrangements themselves, and the routes of redress open to you, are dealt with under the booking terms of the licence holder.

Governing law

These terms are governed by the laws of England and Wales, whose courts have non-exclusive jurisdiction.

Changes

These terms may be updated. The version in force on the date of your booking governs that booking.
